1. About Us

KinderGartenBD is an online platform based in Dhaka, Bangladesh, providing maternity and baby products, parenting resources, pregnancy journey content, doctor appointment booking, and a rewards club for our members.

2. Eligibility & Account Registration

  • You must be at least 18 years old, or accessing the Platform under the supervision of a parent/guardian, to create an account or place an order.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
  • You agree to provide accurate, current, and complete information during registration and to keep it updated.
  • We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

3. Products & Services

  • We display product images, descriptions, and prices as accurately as possible; however, slight variations in color, packaging, or specifications may occur.
  • All prices are listed in Bangladeshi Taka (৳) and are subject to change without prior notice.
  • Product availability is not guaranteed until an order is confirmed.
  • The "Doctor Appointment" feature facilitates connections between users and healthcare providers for informational and scheduling purposes only. We do not provide medical advice, diagnosis, or treatment, and any healthcare decisions remain solely between you and the medical professional.

4. Orders & Payment

  • Placing an order constitutes an offer to purchase, subject to acceptance and confirmation by us.
  • We accept payment via bKash, Nagad, and other listed methods, as well as Cash on Delivery (COD) where available.
  • We reserve the right to cancel or refuse any order due to product unavailability, pricing errors, suspected fraud, or other reasonable grounds. In such cases, any payment made will be refunded.
  • An order confirmation does not guarantee that the listed price or availability is error-free; we will notify you of any material errors before final processing.

5. Shipping & Delivery

  • Estimated delivery timelines will be communicated at checkout or via order confirmation and may vary based on location within Bangladesh.
  • Risk of loss and title for products pass to you upon delivery to the shipping address provided.
  • Delays caused by courier partners, weather, or circumstances beyond our control are not the responsibility of KinderGartenBD, though we will assist in resolving delivery issues where possible.

6. Returns, Refunds & Exchanges

Returns, exchanges, and refunds are governed by our separate Returns and Refund Policy, which forms part of these Terms. Please review it before requesting a return or refund.

7. Rewards Club

  • Membership in the Rewards Club is subject to separate program rules regarding points accrual, redemption, expiry, and eligibility, which we may update from time to time.
  • We reserve the right to modify, suspend, or discontinue the Rewards Club program at our discretion, with reasonable notice to members.

8. User-Generated Content

  • Any reviews, comments, or content you submit (e.g., on articles or products) must not be unlawful, defamatory, obscene, or infringe on any third party's rights.
  • By submitting content, you grant KinderGartenBD a non-exclusive, royalty-free license to use, display, and reproduce it in connection with the Platform.
  • We reserve the right to remove any content that violates these Terms.

9. Intellectual Property

All content on the Platform — including logos, text, graphics, images, articles, and software — is the property of KinderGartenBD or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from this content without our prior written consent.

10. Prohibited Uses

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to our systems, accounts, or data.
  • Upload viruses, malicious code, or engage in activity that disrupts the Platform's functionality.
  • Use automated tools (bots, scrapers) to extract data without our written permission.

11. Limitation of Liability

To the fullest extent permitted by law, KinderGartenBD shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to product misuse, delivery delays, or reliance on informational content (including parenting/health articles, which are for general informational purposes only and not a substitute for professional medical advice).

12. Third-Party Links & Services

The Platform may contain links to third-party websites or services (e.g., social media, payment gateways). We are not responsible for the content, policies, or practices of any third party.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or legal requirements. Updates will be posted on this page with a revised "Last Updated" date. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the People's Republic of Bangladesh. Any disputes arising from these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.
